The agreement between you and AVANTÉ.

1. The agreement and who you contract with

These Terms of Service (“Terms”) govern your use of AVANTÉ at www.avantefit.com and any related applications. AVANTÉ is a brand of DeSouza Strategic Systems LLC; your contract is with DeSouza Strategic Systems LLC, doing business as AVANTÉ (“we”, “us”).

By creating an account or using the service you accept these Terms. If you do not accept them, do not use the service.

2. Eligibility

You must be at least 18 years old to use AVANTÉ. The service is not directed to children, and we do not knowingly collect personal information from anyone under 18. If we learn that we have, we will delete it.

You are responsible for the accuracy of the information you provide and for activity under your account.

3. What the service is — and is not

AVANTÉ produces fit scores, size recommendations, measurement estimates, virtual try-on images, and styling guidance. All of these are estimates generated by automated systems and are provided for decision support.

We do not promise that a garment will fit. Garment measurements vary between production runs, fabrics behave differently on different bodies, and retailer size charts are not standardized. See our Disclosures page for the full statement of what each figure means.

AVANTÉ does not provide medical, health, clinical, legal, or financial advice. Measurements are for garment fit only and must not be used for diagnosis or treatment.

4. Purchases are with retailers, not with us

AVANTÉ is not a retailer and is not a party to your purchase. When you continue to a retailer, that retailer's terms, pricing, taxes, shipping, warranty, and return policy govern the transaction entirely.

We never charge you for a garment, and we cannot accept a return or issue a refund for one. Some retailer links may earn us a commission at no additional cost to you. A commission never affects a fit score, a size recommendation, or the order in which results are ranked by fit.

5. Subscriptions, automatic renewal, cancellation and refunds

AVANTÉ offers a free plan and several paid plans — currently AVANTÉ Plus, AVANTÉ Pro, and AVANTÉ Atelier. The free plan costs nothing, requires no payment method, and never renews. Current prices and what each plan includes are shown on the Pricing page.

Every paid plan is a subscription billed in advance through Stripe. By subscribing to any paid plan you authorise us to charge your payment method on a recurring basis until you cancel.

AUTOMATIC RENEWAL. Every paid plan renews automatically at the end of each billing period, at the then-current price, until you cancel. A monthly subscription renews every month; an annual subscription renews every year. Annual billing is offered only for the plans where it is shown at checkout — AVANTÉ Atelier is currently offered on a monthly basis only.

AVANTÉ Atelier is limited to a fixed number of members. When it is full you may join a waitlist instead of subscribing; joining the waitlist costs nothing, does not create a subscription, and you are not charged unless and until a place opens and you choose to subscribe.

HOW TO CANCEL. You may cancel any paid plan at any time from Account → Plan → Manage subscription, which opens the Stripe billing portal. Cancellation takes effect at the end of the billing period you have already paid for: you keep access until that period ends, and you are not charged again.

Except where the law requires otherwise, payments are non-refundable and we do not provide partial refunds for the unused portion of a billing period. If we change the price of a plan, we will give you notice before the change takes effect and you may cancel before it applies to you.

Search credits and render credits are one-time purchases. They are NOT subscriptions and do not renew automatically. Credits are consumed as you use them and are not refundable once consumed. Credits you have purchased are not cancelled by downgrading or cancelling a subscription.

6. Acceptable use

You agree not to: upload images of anyone other than yourself without their permission; upload unlawful, infringing, or sexual content involving minors; attempt to bypass access controls, quotas, or metering; scrape, resell, or redistribute our outputs; interfere with the service; or use the service to build a competing model or dataset.

We may suspend or terminate an account that violates these Terms or creates risk or legal exposure for us or others.

7. Your content and the licence you grant

You retain all rights in the photos, measurements, and other content you provide. You grant us a limited, non-exclusive, revocable licence to process that content solely to provide the service to you — for example, to estimate measurements or generate a try-on image you requested.

This licence ends when you delete the content or your account, except where we must retain a record to meet a legal obligation. We do not use your photos to train models for other users.

8. Our intellectual property

The AVANTÉ name, marks, software, models, fit engine, design system, and content are owned by DeSouza Strategic Systems LLC and are protected by intellectual property laws. These Terms grant you no licence to them beyond using the service as permitted.

9. Beta service, availability and changes

The service is offered during a beta period on an “as is” and “as available” basis. Features, quotas, recommendations, and published figures may change as models improve and as validation data accrues. We do not commit to any level of availability.

We may modify these Terms. If a change is material, we will give reasonable notice, and continued use after the change takes effect constitutes acceptance.

10. Disclaimer of warranties

To the fullest extent permitted by law, the service is provided without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that fit scores, size recommendations, measurement estimates, or try-on images will be accurate, complete, or suitable for any particular garment or purchase decision.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or the cost of substitute goods, arising out of or relating to the service.

Our total aggregate liability arising out of or relating to the service will not exceed the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred United States dollars (US$100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.

12. Indemnification

You agree to indemnify and hold harmless AVANTÉ and its officers, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the service, your content, or your violation of these Terms or of any law or third-party right.

13. Termination

You may stop using the service and delete your data at any time from the Privacy page. We may suspend or terminate access if you violate these Terms, if required by law, or if continuing to provide the service becomes impractical.

Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive.

14. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Harris County, Texas, and you consent to their personal jurisdiction.

Nothing in this section prevents either party from seeking injunctive relief where available.
